Solid Waste

  • Provided on-site management, financial, accounting and legal support services to a project developer in connection with its operation and maintenance engagement of the largest waste-to-energy facility in the United States, with 70+ employees processing 3,150 TPD of MSW). Our team of professionals assumed total responsibility for guiding and managing the company through the turnaround of an underperforming asset that had been distressed for 25+ years. With Elias Group LLP’s assistance: (i) emission violations at the facility were reduced to zero, where there had previously been over 400 violations per year; (ii) the company earned and was paid bonuses for achieving a perfect environmental record and for maintaining superior facility availability (the amount of time that the facility was able to process solid waste) rates; and (iii) financial performance dramatically improved from a loss in 2012 to increasing profitability in 2013 and 2014.
  • Assisted with a response to a Request for Proposal calling for the design, construction, operation and financing of 1,000 TPD recycling and waste-to-energy project. We participated in all project development efforts prior to and throughout the procurement process, including the proposal preparation and pricing phase, the interview and selection phase and throughout contract negotiations following project award (beating a candidate pool of 13 competing bidders). We provided strategic advice in dealing with local environmental groups. We participated in educational meetings and presentations to government and community groups in an effort to promote the team and proposed technology. We helped screen, select and assemble a world class project execution team. We reviewed and opined on environmental emission standards, recycling requirements and waste disposal diversion requirements and credits. We assisted in setting a price, bidding strategy and in preparing financial pro-forma projections. We prepared and participated in all meetings with the City’s Selection Committee and the City’s financial, technical and legal consultants. Following project selection and award, we engaged in the negotiation of a detailed project term sheet with the City’s attorneys.
  • Engaged by a consortium including a European technology provider and EPC firm selected by a government in Latin America to design-build-own-operate-maintain a 1,000 TPD enhanced power, $300 million waste-to-energy. Our engagement covers the entire gamut of project development efforts including securing and negotiating waste concession and power offtake agreements and assisting with all project finance efforts.
